On Tuesday, the Supreme Court struck out an appeal filed by the Peoples Democratic Party (PDP) and its presidential candidate, Alhaji Atiku Abubakar.
Justice Dattijo Muhammad led a five-man panel which held that the appeal was statute-barred.
The PDP, as well as Atiku, had filed the appeal to challenge a ruling of the Presidential Election Petition Tribunal which held that they failed to file a response to an application made by the ruling APC.
One of the prayers made in the application by the APC was for the tribunal to dismiss the petition of the appellants.
This came with just about 24 hours to the closing of the arguments by parties to the petition which was scheduled to come up on Wednesday.
The PDP, as well as Atiku, are challenging the victory of President Muhammadu Buhari at the February 23, 2019 elections at the tribunal.
